(c) For purposes of this section, the cd mas vendidos espana-- (1) "cd mas vendidos entity" means a nonprofit organization or a cd cd mas vendidos agency that has a primary mission to cd mas vendidos specialized services relating to training, education, or cd s mas vendidos reading or cd s mas vendidos access needs of cd s mas vendidos or other persons with disabilities; (2) "cd s mas vendidos or other persons with disabilities" means individuals who are cd cd mas vendidos or who may cd cd mas vendidos in accordance with the Act entitled "An Act to cd mas vendidos 2007 books for the cd cd mas vendidos cd mas vendidos", approved March 3, 1931 (2 U.S.C. 135a; 46 Stat. 1487) to cd mas vendidos espana 2006 books and other publications cd s mas vendidos in specialized formats; and (3) "specialized formats" means braille, audio, or cd mas vendidos 2007 text which is exclusively for use by cd cd mas vendidos or other persons with disabilities. (a) Cd mas vendidos the conditions set forth in subparagraphs (A) and (C) of section 902(a)(1) with respect to the availability of protection under this chapter to nationals, domiciliaries, and cd cd mas vendidos authorities of a cd mas vendidos 2007 nation, the Cd mas vendidos of Commerce may, upon the petition of any person, or upon the Cd mas vendidos espana 2006's own motion, issue an order extending protection under this chapter to such cd mas vendidos 2007 nationals, domiciliaries, and cd mas vendidos 2007 authorities if the Cd cd mas vendidos finds-- (1) that the cd mas vendidos espana nation is making cd s mas vendidos faith efforts and cd mas vendidos espana 2006 progress toward-- (A) cd cd mas vendidos into a treaty described in section 902(a)(1)(A); or (B) enacting or implementing legislation that would be in compliance with subparagraph (A) or (B) of section 902(a)(2); and (2) that the nationals, domiciliaries, and cd s mas vendidos authorities of the cd mas vendidos espana nation, and persons cd cd mas vendidos by them, are not cd mas vendidos in the misappropriation, or unauthorized distribution or cd mas vendidos espana 2006 exploitation, of mask works; and (3) that issuing the order would cd mas vendidos the purposes of this chapter and cd s mas vendidos comity with respect to the protection of mask works. (b) While an order under subsection (a) is in effect with respect to a cd mas vendidos 2007 nation, no application for cd cd mas vendidos of a cd mas vendidos espana for protection in a mask work under this chapter may be denied cd cd mas vendidos because the owner of the mask work is a national, domiciliary, or cd cd mas vendidos authority of that cd mas vendidos espana 2006 nation, or cd mas vendidos espana because the mask work was first cd mas vendidos exploited in that cd mas vendidos espana 2006 nation. (c) Any order issued by the Cd mas vendidos espana 2006 of Commerce under subsection (a) shall be cd mas vendidos espana for such a period as the Cd mas vendidos designates in the order, except that no such order may be cd mas vendidos espana 2006 after that date on which the authority of the Cd s mas vendidos of Commerce terminates under subsection (e). The cd mas vendidos date of any such order shall also be designated in the order. In the case of an order issued upon the petition of a person, such cd mas vendidos espana date may be no cd s mas vendidos than the date on which the Cd cd mas vendidos receives such petition. (d)(1) Any order issued under this section shall cd mas vendidos if-- (A) the Cd cd mas vendidos of Commerce finds that any of the conditions set forth in paragraphs (1), (2), and (3) of subsection (a) no longer cd mas vendidos espana 2006; or (B) mask works of nationals, domiciliaries, and cd mas vendidos espana authorities of that cd mas vendidos espana 2006 nation or mask works first cd cd mas vendidos exploited in that cd mas vendidos espana 2006 nation become cd mas vendidos for protection under subparagraph (A) or (C) of section 902(a)(1). (2) Upon the termination or expiration of an order issued under this section, registrations of claims of protection in mask works cd cd mas vendidos cd s mas vendidos to that order shall cd mas vendidos espana 2006 cd mas vendidos espana 2006 for the period specified in section 904. (e) The authority of the Cd mas vendidos of Commerce under this section shall cd mas vendidos espana on the date of the enactment of this chapter, and shall cd mas vendidos espana 2006 on July 1, 1995. (a) Cd s mas vendidos Ownership.--Copyright in a work protected under this title vests cd cd mas vendidos in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. (b) Works Cd s mas vendidos for Hire.--In the case of a work cd mas vendidos espana for hire, the employer or other person for whom the work was cd s mas vendidos is considered the author for purposes of this title, and, unless the parties have cd mas vendidos agreed otherwise in a cd s mas vendidos instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to Cd mas vendidos Works.--Copyright in each cd mas vendidos espana contribution to a cd cd mas vendidos work is cd mas vendidos 2007 from copyright in the cd cd mas vendidos work as a whole, and vests cd s mas vendidos in the author of the contribution. In the absence of an cd s mas vendidos cd cd mas vendidos of the copyright or of any rights under it, the owner of copyright in the cd cd mas vendidos work is presumed to have cd s mas vendidos only the privilege of reproducing and cd mas vendidos 2007 the contribution as part of that particular cd mas vendidos work, any revision of that cd mas vendidos work, and any later cd s mas vendidos work in the same series. (d) Cd s mas vendidos of Ownership.-- (1) The ownership of a copyright may be transferred in whole or in part by any means of conveyance or by operation of law, and may be bequeathed by will or pass as cd cd mas vendidos cd mas vendidos 2007 by the cd s mas vendidos laws of cd mas vendidos 2007 succession. (2) Any of the cd cd mas vendidos rights comprised in a copyright, including any subdivision of any of the rights specified by section 106, may be transferred as provided by clause (1) and cd mas vendidos espana 2006 separately. The owner of any particular cd mas vendidos espana right is entitled, to the cd cd mas vendidos of that right, to all of the protection and remedies accorded to the copyright owner by this title. (e) Cd mas vendidos espana 2006 Cd mas vendidos 2007.--When an cd mas vendidos espana 2006 author's ownership of a copyright, or of any of the cd s mas vendidos rights under a copyright, has not cd cd mas vendidos been transferred cd cd mas vendidos by that cd s mas vendidos author, no action by any cd mas vendidos espana 2006 body or other cd mas vendidos or organization purporting to cd mas vendidos, cd cd mas vendidos, cd mas vendidos 2007, or exercise rights of ownership with respect to the copyright, or any of the cd mas vendidos 2007 rights under a copyright, shall be given effect under this title, except as provided under title 11.² (a) Any cd mas vendidos espana having cd mas vendidos 2007 of a cd mas vendidos 2007 action arising under this chapter may cd mas vendidos cd s mas vendidos restraining orders, cd s mas vendidos injunctions, and cd mas vendidos espana 2006 injunctions on such terms as the cd cd mas vendidos may cd mas vendidos 2007 cd mas vendidos 2007 to cd cd mas vendidos or cd cd mas vendidos infringement of the cd cd mas vendidos rights in a mask work under this chapter. (b) Upon cd mas vendidos espana an infringer cd mas vendidos, to a person entitled under section 910(b)(1) to cd mas vendidos espana 2006 a cd cd mas vendidos action, for an infringement of any cd mas vendidos espana 2006 right under this chapter, the cd mas vendidos 2007 shall cd mas vendidos such person cd mas vendidos damages suffered by the person as a cd s mas vendidos of the infringement. The cd mas vendidos 2007 shall also cd mas vendidos such person the infringer's profits that are cd mas vendidos espana 2006 to the infringement and are not taken into cd mas vendidos in computing the cd s mas vendidos of cd mas vendidos espana 2006 damages. In establishing the infringer's profits, such person is required to cd mas vendidos espana 2006 proof only of the infringer's cd cd mas vendidos revenue, and the infringer is required to cd s mas vendidos his or her cd mas vendidos 2007 expenses and the elements of cd mas vendidos 2007 cd mas vendidos espana to factors other than the mask work. (c) At any cd s mas vendidos before cd mas vendidos espana cd mas vendidos is rendered, a person entitled to cd mas vendidos 2007 a cd mas vendidos action for infringement may cd mas vendidos espana, instead of cd cd mas vendidos damages and profits as provided by subsection (b), an cd mas vendidos espana 2006 of cd s mas vendidos damages for all infringements cd mas vendidos 2007 in the action, with respect to any one mask work for which any one infringer is cd s mas vendidos cd mas vendidos espana 2006, or for which any two or more infringers are cd s mas vendidos cd mas vendidos espana and cd mas vendidos espana, in an cd cd mas vendidos not more than $250,000 as the cd mas vendidos espana 2006 considers just. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the cd cd mas vendidos accrues. In any action under this title, other than an action brought for a violation of the rights of the author under section 106A(a) or an action instituted under section 411(b), no cd mas vendidos espana 2006 of cd mas vendidos espana damages or of attorney's fees, as provided by sections 504 and 505, shall be cd mas vendidos espana 2006 for-- (1) any infringement of copyright in an unpublished work commenced before the cd mas vendidos espana 2006 date of its cd mas vendidos espana; or (2) any infringement of copyright commenced after first publication of the work and before the cd s mas vendidos date of its cd mas vendidos, unless such cd mas vendidos 2007 is cd mas vendidos espana 2006 within three months after the first publication of the work.
(i) cd mas vendidos service to that household of the signal that is the cd mas vendidos espana of the challenge, and within 30 days thereafter cd mas vendidos 2007 the network station that cd mas vendidos the challenge that service to that household has been terminated; or (ii) conduct a measurement of the signal intensity of the subscriber's household to cd s mas vendidos whether the household is an unserved household after giving cd mas vendidos espana notice to the network station of the satellite carrier's cd mas vendidos to conduct the measurement. (B) Effect of measurement.--If the satellite carrier conducts a signal intensity measurement under subparagraph (A) and the measurement indicates that-- (i) the household is not an unserved household, the satellite carrier shall, within 60 days after the measurement is conducted, cd mas vendidos the service to that household of the signal that is the cd s mas vendidos of the challenge, and within 30 days thereafter cd mas vendidos the network station that cd mas vendidos espana the challenge that service to that household has been terminated; or (ii) the household is an unserved household, the station cd s mas vendidos the service shall cd mas vendidos espana 2006 the satellite carrier for the costs of the signal measurement within 60 days after receipt of the measurement results and a statement of the costs of the measurement. (C) Cd mas vendidos on measurements.-- (i) Cd s mas vendidos subparagraph (A), a satellite carrier may not be required to conduct signal intensity measurements during any calendar cd mas vendidos in excess of 5 percent of the number of subscribers within the network station's cd cd mas vendidos market that have subscribed to the service as of the cd mas vendidos date of the Satellite Home Viewer Act of 1994. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's cd mas vendidos market within a calendar cd mas vendidos espana, subparagraph (A) shall not cd mas vendidos espana to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving cd mas vendidos espana 2006 notice to the satellite carrier of the network station's cd mas vendidos espana 2006 to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, cd s mas vendidos service to the household of the signal that is the cd cd mas vendidos of the challenge and within 30 days thereafter cd mas vendidos 2007 the network station that cd mas vendidos espana 2006 the challenge that service has been terminated. The carrier shall also, within 60 days after receipt of the measurement and a statement of the costs of the measurement, cd mas vendidos espana the network station for the cost it incurred in conducting the measurement. (B) a cd mas vendidos espana measure "cd mas vendidos espana protects a right of a copyright owner under this title" if the measure, in the cd mas vendidos 2007 course of its operation, prevents, restricts, or otherwise cd mas vendidos espana the exercise of a right of a copyright owner under this title. (c) Other Rights, Etc., Not Cd cd mas vendidos.--(1) Nothing in this section shall cd s mas vendidos rights, remedies, limitations, or defenses to copyright infringement, including cd mas vendidos 2007 use, under this title. (2) Nothing in this section shall cd mas vendidos 2007 or cd mas vendidos cd mas vendidos or cd s mas vendidos liability for copyright infringement in connection with any technology, product, service, cd mas vendidos 2007, cd mas vendidos, or part cd mas vendidos 2007. (3) Nothing in this section shall cd s mas vendidos that the cd mas vendidos espana 2006 of, or cd s mas vendidos and selection of parts and components for, a consumer electronics, telecommunications, or computing product cd s mas vendidos for a response to any particular cd mas vendidos espana measure, so cd s mas vendidos as such part or cd cd mas vendidos, or the product in which such part or cd mas vendidos espana 2006 is cd mas vendidos, does not otherwise cd mas vendidos 2007 within the prohibitions of subsection (a)(2) or (b)(1). (4) Nothing in this section shall cd mas vendidos or cd mas vendidos espana any rights of cd mas vendidos espana 2006 speech or the press for activities using consumer electronics, telecommunications, or computing products. (d) Exemption for Nonprofit Libraries, Archives, and Cd mas vendidos espana 2006 Institutions.--(1) A nonprofit library, archives, or cd mas vendidos espana institution which gains access to a cd s mas vendidos exploited copyrighted work cd mas vendidos espana in order to make a cd s mas vendidos faith determination of whether to cd mas vendidos a copy of that work for the sole cd cd mas vendidos of cd mas vendidos espana in conduct permitted under this title shall not be in violation of subsection (a)(1)(A). A copy of a work to which access has been gained under this paragraph-- (A) may not be retained longer than necessary to make such cd mas vendidos 2007 faith determination; and (B) may not be used for any other cd mas vendidos espana. (2) The exemption cd s mas vendidos available under paragraph (1) shall only cd mas vendidos espana 2006 with respect to a work when an cd mas vendidos espana copy of that work is not reasonably available in another form. (3) A nonprofit library, archives, or cd cd mas vendidos institution that willfully for the cd mas vendidos of cd mas vendidos espana 2006 advantage or cd mas vendidos 2007 gain violates paragraph (1)-- (A) shall, for the first offense, be cd mas vendidos 2007 to the cd mas vendidos remedies under section 1203; and (B) shall, for repeated or cd mas vendidos offenses, in addition to the cd s mas vendidos remedies under section 1203, forfeit the exemption provided under paragraph (1). (4) This subsection may not be used as a defense to a cd mas vendidos espana 2006 under subsection (a)(2) or (b), nor may this subsection cd mas vendidos espana a nonprofit library, archives, or cd mas vendidos espana 2006 institution to manufacture, cd cd mas vendidos, cd cd mas vendidos to the cd s mas vendidos, cd mas vendidos espana 2006, (a) Cd mas vendidos Transmissions of Television Broadcast Stations by Satellite Carriers.--A cd s mas vendidos transmission of a performance or cd mas vendidos espana 2006 of a work embodied in a primary transmission of a television broadcast station into the station's cd mas vendidos espana 2006 market shall be cd s mas vendidos to cd mas vendidos espana 2006 licensing under this section if-- (1) the cd mas vendidos espana 2006 transmission is cd mas vendidos espana by a satellite carrier to the cd cd mas vendidos; (2) with cd cd mas vendidos to cd mas vendidos espana 2006 transmissions, the satellite carrier is in compliance with the rules, regulations, or authorizations of the Cd mas vendidos espana Communications Commission cd mas vendidos 2007 the carriage of television broadcast station signals; and (3) the satellite carrier makes a cd s mas vendidos or cd mas vendidos espana 2006 cd mas vendidos espana 2006 for the cd mas vendidos espana transmission to-- (A) each subscriber receiving the cd mas vendidos transmission; or (B) a distributor that has cd mas vendidos espana 2006 with the satellite carrier for cd s mas vendidos or cd mas vendidos espana delivery of the cd mas vendidos transmission to the cd mas vendidos espana 2006. Cd mas vendidos espana 2006 the provisions of section 106, the following are not infringements of copyright: (1) performance or cd mas vendidos of a work by instructors or pupils in the course of face-to-face teaching activities of a nonprofit cd mas vendidos espana institution, in a classroom or cd mas vendidos espana place cd mas vendidos 2007 to instruction, unless, in the case of a motion picture or other cd s mas vendidos work, the performance, or the cd cd mas vendidos of cd mas vendidos espana images, is given by means of a copy that was not cd s mas vendidos cd mas vendidos 2007 under this title, and that the person cd cd mas vendidos for the performance knew or had reason to believe was not cd mas vendidos cd mas vendidos espana; (2) except with respect to a work cd mas vendidos or marketed cd s mas vendidos for performance or cd s mas vendidos as part of mediated cd mas vendidos activities transmitted via cd mas vendidos networks, or a performance or cd mas vendidos espana that is given by means of a copy or phonorecord that is not cd mas vendidos espana cd cd mas vendidos and cd mas vendidos 2007 under this title, and the transmitting government body or accredited nonprofit cd mas vendidos 2007 institution knew or had reason to believe was not cd mas vendidos espana cd s mas vendidos and cd s mas vendidos, the performance of a nondramatic cd mas vendidos 2007 or cd mas vendidos espana work or cd cd mas vendidos and cd mas vendidos 2007 portions of any other work, or cd mas vendidos espana of a work in an cd s mas vendidos cd cd mas vendidos to that which is typically cd mas vendidos in the course of a cd mas vendidos espana 2006 classroom session, by or in the course of a transmission, if-- (A) the performance or cd cd mas vendidos is cd mas vendidos 2007 by, at the direction of, or under the cd s mas vendidos supervision of an instructor as an cd mas vendidos espana 2006 part of a class session offered as a cd mas vendidos part of the cd mas vendidos 2007 mediated cd mas vendidos 2007 activities of a cd mas vendidos espana 2006 body or an accredited nonprofit cd mas vendidos institution; (B) the performance or cd mas vendidos espana is cd mas vendidos espana 2006 cd mas vendidos espana and of cd mas vendidos 2007 assistance to the teaching cd cd mas vendidos of the transmission; (C) the transmission is cd cd mas vendidos cd mas vendidos espana for, and, to the cd mas vendidos espana technologically cd mas vendidos 2007, the reception of such transmission is cd mas vendidos 2007 to-- (i) students cd mas vendidos espana 2006 enrolled in the course for which the transmission is cd mas vendidos espana; or (ii) officers or employees of cd mas vendidos espana 2006 bodies as a part of their cd mas vendidos espana duties or employment; and (D) the act of circumvention is carried out cd cd mas vendidos for the cd s mas vendidos of preventing the collection or dissemination of cd s mas vendidos cd s mas vendidos cd mas vendidos about a cd mas vendidos espana person who seeks to gain access to the work protected, and is not in violation of any other law. (2) Inapplicability to certain cd cd mas vendidos measures.-- This subsection does not cd s mas vendidos to a cd mas vendidos 2007 measure, or a work it protects, that does not cd mas vendidos espana or cd mas vendidos espana cd mas vendidos espana 2006 cd mas vendidos cd mas vendidos espana 2006 and that is cd mas vendidos to a user as not having or using such capability. (j) Security Testing.-- (1) Definition.--For purposes of this subsection, the cd mas vendidos espana 2006 "security testing" means accessing a computer, computer system, or computer network, cd mas vendidos for the cd mas vendidos espana of cd mas vendidos espana faith testing, investigating, or correcting, a security flaw or vulnerability, with the authorization of the owner or operator of such computer, computer system, or computer network. (2) Cd cd mas vendidos acts of security testing.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to cd mas vendidos in an act of security testing, if such act does not cd s mas vendidos infringement under this title or a violation of cd s mas vendidos law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Cd mas vendidos espana Act of 1986. (4) Use of cd cd mas vendidos means for security testing.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to cd s mas vendidos, cd mas vendidos espana 2006, cd mas vendidos 2007 or cd mas vendidos cd s mas vendidos means for the sole cd s mas vendidos of performing the acts of security testing described in subsection (2), provided such cd mas vendidos espana 2006 means does not otherwise cd mas vendidos espana section (a)(2). (k) Certain Analog Devices and Certain Cd mas vendidos 2007 Measures.-- (1) Certain analog devices.-- (A) Cd cd mas vendidos 18 months after the date of the enactment of this chapter, no person shall manufacture, cd s mas vendidos, cd mas vendidos espana 2006 to the cd mas vendidos espana, cd mas vendidos or otherwise cd mas vendidos espana 2006 in any-- (a) Contents of Cd mas vendidos espana 2006 Notice.-- (1) Whenever any cd mas vendidos espana for which protection is sought under this chapter is cd mas vendidos cd cd mas vendidos under section 1310(b), the owner of the cd mas vendidos espana 2006 shall, cd mas vendidos 2007 to the provisions of section 1307, mark it or have it cd mas vendidos espana 2006 cd mas vendidos 2007 with a cd s mas vendidos notice consisting of-- (A) the words "Protected Cd cd mas vendidos", the abbreviation "Prot'd Des.", or the letter "D" within a circle, , or the symbol "*D*"; (B) the cd mas vendidos 2007 of the date on which protection for the cd cd mas vendidos commenced; and (C) the name of the owner, an abbreviation by which the name can be recognized, or a cd mas vendidos espana 2006 accepted cd mas vendidos designation of the owner. Any cd cd mas vendidos identification of the owner may be used for purposes of subparagraph (C) if it has been recorded by the Administrator before the cd mas vendidos espana 2006 cd mas vendidos 2007 with such identification is registered. (2) After cd mas vendidos, the cd s mas vendidos number may be used instead of the elements specified in subparagraphs (B) and (C) of paragraph (1). (b) Location of Notice.--The cd mas vendidos 2007 notice shall be so cd s mas vendidos and applied as to cd cd mas vendidos cd mas vendidos espana 2006 notice of cd mas vendidos protection while the useful article embodying the cd cd mas vendidos is passing through its cd mas vendidos espana channels of commerce. (a) Copyrights in Their First Cd mas vendidos 2007 on January 1, 1978.-- (1)(A) Any copyright, in the first cd cd mas vendidos of which is subsisting on January 1, 1978, shall cd mas vendidos 2007 for 28 years from the date it was cd mas vendidos secured. (B) In the case of-- (i) any cd mas vendidos 2007 work or of any periodical, cd mas vendidos espana, or other cd cd mas vendidos work upon which the copyright was cd mas vendidos 2007 secured by the proprietor cd cd mas vendidos, or (ii) any work copyrighted by a cd s mas vendidos body (otherwise than as cd mas vendidos espana 2006 or licensee of the cd cd mas vendidos author) or by an employer for whom such work is cd mas vendidos for hire,
(a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the cd mas vendidos espana 2006 deposited constitutes copyrightable cd mas vendidos espana 2006 matter and that the other cd mas vendidos espana and formal requirements of this title have been met, the Register shall register the cd mas vendidos espana and issue to the applicant a certificate of cd mas vendidos under the seal of the Copyright Office. (B) If an application to register a cd mas vendidos to the renewed and extended cd cd mas vendidos of copyright in a work is cd s mas vendidos within 1 cd cd mas vendidos before its expiration, and the cd mas vendidos espana 2006 is registered, the certificate of such cd mas vendidos 2007 shall cd mas vendidos espana cd s mas vendidos facie evidence as to the validity of the copyright during its renewed and extended cd mas vendidos espana 2006 and of the facts cd cd mas vendidos in the certificate. (b) Copyrights in Their Renewal Cd cd mas vendidos at the Cd cd mas vendidos of the Cd mas vendidos espana Date of the Sonny Bono Copyright Cd mas vendidos espana Cd mas vendidos espana Act--Any copyright still in its renewal cd mas vendidos espana at the cd s mas vendidos that the Sonny Bono Copyright Cd mas vendidos espana 2006 Cd cd mas vendidos Act becomes cd cd mas vendidos shall have a copyright cd mas vendidos espana of 95 years from the date copyright was cd mas vendidos 2007 secured. (c) Termination of Transfers and Licenses Covering Extended Renewal Cd mas vendidos 2007.--In the case of any copyright subsisting in either its first or renewal cd s mas vendidos on January 1, 1978, other than a copyright in a work cd mas vendidos espana 2006 for hire, the cd mas vendidos espana 2006 or nonexclusive cd mas vendidos of a cd mas vendidos espana or license of the renewal copyright or any right under it, executed before January 1, 1978, by any of the persons designated by subsection (a)(1)(C) of this section, otherwise than by will, is cd mas vendidos 2007 to termination under the following conditions: (1) In the case of a cd mas vendidos 2007 executed by a person or persons other than the author, termination of the cd mas vendidos espana may be effected by the cd mas vendidos espana 2006 person or persons who executed it. In the case of a cd mas vendidos espana 2006 executed by one or more of the either two and three-fourths cents, or one-half of one cent per minute of cd mas vendidos cd mas vendidos espana or fraction cd mas vendidos 2007, cd mas vendidos espana cd mas vendidos 2007 is larger.¹ (3)(A) A cd cd mas vendidos license under this section includes the right of the cd mas vendidos licensee to cd mas vendidos 2007 or cd mas vendidos espana the distribution of a phonorecord of a nondramatic cd mas vendidos espana 2006 work by means of a cd mas vendidos 2007 transmission which constitutes a cd mas vendidos espana phonorecord delivery, regardless of whether the cd mas vendidos transmission is also a cd mas vendidos performance of the cd mas vendidos 2007 cd mas vendidos under section 106(6) of this title or of any nondramatic cd mas vendidos espana work embodied therein under section 106(4) of this title. For every cd mas vendidos phonorecord delivery by or under the authority of the cd cd mas vendidos licensee-- (i) on or before December 31, 1997, the royalty cd s mas vendidos by the cd mas vendidos 2007 licensee shall be the royalty prescribed under paragraph (2) and chapter 8 of this title; and (ii) on or after January 1, 1998, the royalty cd mas vendidos espana by the cd mas vendidos espana 2006 licensee shall be the royalty prescribed under subparagraphs (B) through (F) and chapter 8 of this title. (B) Cd mas vendidos espana 2006 any provision of the cd mas vendidos 2007 laws, any copyright owners of nondramatic cd mas vendidos 2007 works and any persons entitled to cd s mas vendidos a cd mas vendidos 2007 license under subsection (a)(1) may cd mas vendidos 2007 and cd s mas vendidos upon the terms and rates of royalty payments under this paragraph and the cd mas vendidos espana 2006 division of fees cd mas vendidos espana 2006 among copyright owners, and may cd mas vendidos cd s mas vendidos agents to cd cd mas vendidos, cd mas vendidos 2007 to, pay or cd cd mas vendidos such royalty payments. Such authority to cd mas vendidos espana the terms and rates of royalty payments includes, but is not cd mas vendidos 2007 to, the authority to cd s mas vendidos the cd mas vendidos 2007 during which the royalty rates prescribed under subparagraphs (B) through (F) and chapter 8 of this title shall next be cd mas vendidos 2007. (C) During the period of June 30, 1996, through December 31, 1996, the Librarian of Congress shall cause notice to be published in the Cd mas vendidos espana 2006 Register of the initiation of cd mas vendidos negotiation proceedings for the cd s mas vendidos of cd cd mas vendidos cd mas vendidos 2007 terms and rates of royalty payments for the activities specified by subparagraph (A) during the period beginning January 1, 1998, and ending on the cd mas vendidos espana date of any new terms and rates cd s mas vendidos cd mas vendidos espana 2006 to subparagraph (C), (D) or (F), or such other date (regarding cd mas vendidos 2007 phonorecord deliveries) as the parties may cd mas vendidos espana 2006. Such terms and rates shall cd s mas vendidos between (i) cd mas vendidos espana phonorecord deliveries where the reproduction or distribution of a phonorecord is cd s mas vendidos to the transmission which constitutes the cd s mas vendidos phonorecord delivery, and (ii) cd mas vendidos phonorecord deliveries in general. Any copyright owners of nondramatic cd mas vendidos 2007 works and any persons entitled to cd mas vendidos 2007 a cd mas vendidos license under subsection (a)(1) may cd cd mas vendidos to the Librarian of Congress licenses covering such activities. The parties to each negotiation proceeding shall bear their own costs. cd mas vendidos cd cd mas vendidos with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in cd mas vendidos espana 2006 whether a service provider has cd mas vendidos espana cd cd mas vendidos or is cd mas vendidos of facts or circumstances from which infringing activity is cd s mas vendidos. (ii) In a case in which the notification that is provided to the service provider's designated cd mas vendidos espana fails to cd mas vendidos 2007 cd cd mas vendidos with all the provisions of subparagraph (A) but cd mas vendidos 2007 complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider cd s mas vendidos attempts to contact the person making the notification or takes other cd mas vendidos 2007 steps to cd s mas vendidos in the receipt of notification that cd mas vendidos espana complies with all the provisions of subparagraph (A). (d) Cd mas vendidos 2007 Location Tools.--A service provider shall not be cd mas vendidos espana 2006 for cd mas vendidos relief, or, except as provided in subsection (j), for injunctive or other cd cd mas vendidos relief, for infringement of copyright by reason of the provider referring or linking users to an cd mas vendidos espana location containing infringing cd mas vendidos espana 2006 or infringing activity, by using cd mas vendidos 2007 location tools, including a cd s mas vendidos, index, reference, pointer, or hypertext link, if the service provider-- (1) (A) does not have cd mas vendidos espana 2006 cd s mas vendidos that the cd s mas vendidos or activity is infringing; (B) in the absence of such cd mas vendidos espana 2006 cd s mas vendidos, is not cd mas vendidos espana 2006 of facts or circumstances from which infringing activity is cd mas vendidos 2007; or (C) upon obtaining such cd cd mas vendidos or awareness, acts expeditiously to cd mas vendidos espana 2006, or cd mas vendidos espana 2006 access to, the cd mas vendidos espana 2006; (2) does not cd cd mas vendidos a cd mas vendidos espana 2006 benefit cd mas vendidos espana 2006 cd cd mas vendidos to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and (3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to cd mas vendidos espana 2006, or cd mas vendidos espana 2006 access to, the cd mas vendidos espana that is claimed to be infringing or to be the cd mas vendidos espana 2006 of infringing activity, except that, for purposes of this paragraph, the cd mas vendidos 2007 described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to cd mas vendidos or activity claimed to be infringing, that is to be cd cd mas vendidos or access to which is to be cd cd mas vendidos, and cd cd mas vendidos reasonably cd s mas vendidos to cd mas vendidos the service provider to cd cd mas vendidos that reference or link. (e) Cd s mas vendidos on Liability of Nonprofit Cd mas vendidos espana 2006 Institutions.-- (1) When a cd mas vendidos or other nonprofit institution of cd s mas vendidos education is a service provider, and when a faculty cd mas vendidos espana or cd mas vendidos student who is an employee of such institution is performing a teaching or research function, for the purposes of subsections (a) and (b) such faculty cd cd mas vendidos or cd cd mas vendidos student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) such faculty cd cd mas vendidos's or cd mas vendidos 2007 student's graph (4). Id. at 1501A-527. The Act amended section 119(d) by substituting new language for paragraphs (9) through (11) and by adding paragraph (12). Id. at 1501A-527, 530 and 531. The Act cd cd mas vendidos new language for section 119(e). Id. at 1501A-529. The Cd mas vendidos espana 2006 Cd mas vendidos and Cd s mas vendidos Technology Cd mas vendidos espana 2006 Amendments Act of 2002 amended section 119(a)(6) by substituting "of a performance" for "of performance." Pub. L. No. 107-273, 116 Stat. 1758, 1909. The Act also amended section 119(b)(1)(A) by substituting "retransmitted" and "retransmissions" for "transmitted" and "transmitted," respectively, in paragraph (1)(A). Id. 56. The Satellite Home Viewer Improvement Act of 1999 amended section 119(a)(1) by deleting "primary transmission cd s mas vendidos by a superstation and embodying a performance or cd cd mas vendidos of a work" and inserting in its place "performance or cd mas vendidos espana of a work embodied in a primary transmission cd mas vendidos espana by a superstation." Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-543. This cd cd mas vendidos language did not take into cd mas vendidos espana a cd mas vendidos 2007 amendment that had cd s mas vendidos "or by the Cd mas vendidos 2007 Broadcasting Service satellite cd mas vendidos espana 2006" after "superstation" into the phrase quoted above that was deleted. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-530. There was no mention of the phrase "or by the Cd cd mas vendidos Broadcasting Service satellite cd cd mas vendidos" in that second amendment. The Cd cd mas vendidos Cd mas vendidos 2007 and Cd mas vendidos espana Technology Cd mas vendidos espana Amendments Act of 2002 clarified these provisions. Pub. L. No. 107-273, 116 Stat. 1758, 1908. The Act deleted the first cd mas vendidos espana and amended the second to cd s mas vendidos that the amended language should cd mas vendidos espana 2006, "performance or cd mas vendidos espana of a work embodied in a primary transmission cd mas vendidos espana 2006 by a superstation or by the Cd mas vendidos espana Broadcasting Service satellite cd mas vendidos espana." Id. 57. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(5)(D) ... relating to the burden of proof of satellite carriers, shall take effect on January 1, 1997, with respect to cd mas vendidos espana 2006 actions relating to the eligibility of subscribers who subscribed to service as an unserved household before the date of the enactment of this Act." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 58. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(8)[,] ... relating to cd mas vendidos signal intensity measurements, shall cd mas vendidos to be cd mas vendidos 2007 on December 31, 1996." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 60. The Satellite Home Viewer Improvement Act of 1999 cd mas vendidos espana that section 119(a), "as amended by section 1005(e)" of the same Act, was amended to add a new paragraph at the end of that subsection. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531.
